Welcome to Craft, an AI-powered video generation platform operated by Craft ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website at craft.video and our video generation services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Craft is an AI video generation platform that allows users to create video content using artificial intelligence technology powered by Google Cloud Vertex AI (Veo 3 family) and optional OpenAI Sora 2 preview models. Our Service includes:

• AI-powered video generation from text prompts with multi-segment stitching
• Audio integration and sound effect capabilities delivered through ElevenLabs, Google Cloud Text-to-Speech, and Amazon Polly
• Video editing, canvas overlays, and customization tools
• Content library, remixing, and community showcase features
• Credit-based usage system with both Stripe and crypto payment options
• API access, webhooks, and developer tooling

We may release beta or preview functionality, including experimental AI models or tooling. Beta features are provided for evaluation purposes only and may be modified, rate-limited, or discontinued without notice.

3. User Accounts and Registration

Account Creation

• You must provide a valid email address to create an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 13 years old to use our Service
• One person or legal entity may maintain only one account

Account Responsibilities

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Credit System and Billing

Credit Purchase

• Our Service operates on a credit-based system
• Credits are required to generate videos and use premium features
• Credits can be purchased through our secure payment system powered by Stripe or approved crypto payment providers
• All prices are listed in USD and include applicable taxes

Payment Terms

• Payment is due immediately upon purchase
• We process major credit and debit cards through Stripe and other PCI-compliant processors
• All sales are final; credits are non-refundable except as required by law
• We may hold transactions pending manual review for fraud prevention or regulatory compliance
• We reserve the right to change pricing with 30 days notice

Crypto Payments

• We optionally accept USDC payments on Ethereum Mainnet to the wallet address displayed in the app
• You are responsible for sending funds from a compatible wallet, covering network fees, and ensuring the correct blockchain network
• Blockchain transactions are irreversible; credits are issued only after the required on-chain confirmations are detected
• We record transaction hashes, wallet addresses, and payment amounts for reconciliation, fraud prevention, and regulatory compliance
• Underpayments, overpayments, or transactions on unsupported networks may be rejected or require manual review at our discretion

Referral and Affiliate Programs

• We provide referral links or affiliate codes that credit new signups to the referring account
• Referral rewards are issued as credits or commissions once eligibility criteria are met
• We track referral identifiers, redemption history, and related analytics to prevent abuse
• Misuse of referral programs, including self-referrals or fraudulent signups, may result in forfeiture of rewards and account suspension

Credit Usage and Expiration

• Credits are consumed when generating videos or using premium features
• Credits do not expire unless your account remains inactive for 12 consecutive months
• Credit consumption rates may vary based on video length, quality, and complexity
• You can monitor your credit balance through your account interface

5. Acceptable Use Policy

Permitted Uses

You may use our Service to create videos for legitimate purposes, including:

• Personal, educational, or commercial content creation
• Marketing and promotional materials
• Social media content
• Entertainment and creative projects

Prohibited Content

You may not use our Service to create content that:

• Violates any applicable laws or regulations
• Infringes on intellectual property rights of others
• Contains hate speech, harassment, or discriminatory content
• Depicts violence, explicit sexual content, or child exploitation
• Promotes illegal activities or harmful behavior
• Contains malware, viruses, or malicious code
• Impersonates another person or entity without permission
• Spreads misinformation or deepfakes intended to deceive
• Violates privacy rights of individuals
• Violates the usage policies of our AI model providers (including Google Cloud Vertex AI and OpenAI)

Content Moderation

• We reserve the right to review and moderate content created using our Service
• Violating content may be removed without notice
• Repeated violations may result in account suspension or termination
• We may use automated systems to detect prohibited content and share necessary details with model providers to enforce acceptable use rules

API Usage

• API keys and webhooks provided by Craft must be kept confidential and used only by the authorized account
• You must comply with published rate limits and avoid automated traffic that degrades platform performance
• We may revoke API access that results in abuse, security risks, or violations of these Terms or upstream provider policies

6. Intellectual Property Rights

Your Content

• You retain ownership of the prompts, audio, and original content you provide
• Videos generated by our AI become your property upon creation
• You are responsible for ensuring you have rights to any input content you provide
• You grant us a limited license to process your content for service delivery and quality assurance
• If you submit content to community features (including the community showcase or template gallery), you grant us a worldwide, royalty-free license to display, distribute, and promote that content within the Service. You may opt out of showcase participation via account settings or support.
• We do not use your prompts or uploads to retrain AI models without your explicit consent

Our Intellectual Property

• The Craft platform, including software, design, and features, is our property
• Our trademarks, logos, and brand elements are protected intellectual property
• You may not copy, modify, or reverse engineer our platform
• AI model technology is licensed from Google Cloud and OpenAI; use of these models is subject to the respective provider terms and acceptable use policies

Third-Party Content

• You must respect intellectual property rights of third parties
• Do not use copyrighted material without proper authorization
• We are not responsible for copyright infringement by users
• We will respond to valid DMCA takedown notices

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms. Key points include:

• Video generation is performed using Google Cloud Vertex AI and, when enabled, OpenAI Sora 2 services

• We share limited data with third-party processors such as Stripe, Google Cloud, OpenAI, ElevenLabs, Amazon Polly, and hCaptcha solely to deliver the Service
• You have rights regarding your personal data

8. Service Availability and Limitations

Service Availability

• We strive to maintain 99.9% uptime but do not guarantee uninterrupted service
• Planned maintenance will be communicated in advance when possible
• We reserve the right to modify or discontinue features with notice, including beta or preview model integrations
• Third-party model providers, payment processors, or blockchain networks may experience outages or delays outside our control

Usage Limitations

• Rate limits may apply to prevent abuse and ensure fair usage
• Video generation may have duration and resolution limits
• API usage is subject to rate limiting and quotas
• We may implement additional limits to maintain service quality, comply with model provider policies, or protect system stability

9. Disclaimers and Limitations of Liability

Service Disclaimers

• Our Service is provided "as is" without warranties of any kind
• We do not guarantee the accuracy or quality of AI-generated content
• Generated videos may not always meet your specific requirements
• AI technology may produce unexpected or unintended results, including output from third-party models operated by Google Cloud or OpenAI
• Crypto payments are subject to blockchain congestion, gas fees, and other risks inherent to decentralized networks

Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the 12 months preceding the claim
• We are not responsible for third-party services or content, including AI model providers, crypto networks, wallet software, or payment processors
• Users are responsible for backing up their generated content

10. Account Termination

Termination by You

• You may terminate your account at any time through your account settings
• Unused credits will be forfeited upon account deletion
• Some data may be retained for legal and security purposes

Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Abuse our Service or harm other users
• Fail to pay for purchased credits

Binding Arbitration

You agree that disputes must be resolved on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.
